US farmers challenging Monsanto patent claims appeal to Supreme Court

Public advocacy groups and farmers have joined forces to challenge biotech giant Monsanto’s claims on genetically engineered seed patents, and to halt the company’s aggressive lawsuits against anyone whose fields are contaminated by their GMOs.
Seventy-three US farmers, seed companies, and public advocacy groups appealed their case against Monsanto Co. to the Supreme Court on Thursday.
The case seeks to challenge Monsanto’s aggressive claims on patents of genetically-engineered seeds and aims to bar the chemical and biotech company from suing anyone whose field is contaminated by such seeds.
Monsanto has in the past sued over 100 farmers for patent infringement and won cases against farmers who were found to have used seeds without paying the company royalties.
In June, the US Court of Appeals for the Federal Circuit affirmed a previous ruling which states that the group of organic and otherwise non-GMO farmers and other plaintiffs do not have standing to prohibit Monsanto from suing them should the company’s genetic traits end up on their holdings"because Monsanto has made binding assurances that it will not 'take legal action against growers whose crops might inadvertently contain traces of Monsanto biotech genes (because, for example, some transgenic seed or pollen blew onto the grower's land).'"
But the company’s assurances did not assuage the plaintiffs’ fear of future alleged patent infringement.
"While the Court of Appeals correctly found that the farmers and seed sellers had standing to challenge Monsanto's invalid patents, it incorrectly found that statements made by Monsanto's lawyers during the lawsuit mooted the case," said Daniel Ravicher, Executive Director of the Public Patent Foundation (PUBPAT) and lead counsel to the plaintiffs in the case, OSGATA et al v. Monsanto. "As a result, we have asked the Supreme Court to take the case and reinstate the right of the plaintiffs to seek full protection from Monsanto's invalid transgenic seed patents."
Ravicher says the company’s patents on genetically-modified seeds don’t meet the “usefulness”requirement of patent law. The plaintiffs’ filing cites evidence proving that the genetically-engineered seeds have negative economic and health effects, while the supposed benefits for food production and avoiding toxic pesticides are weak.
“As the leading arbiters of justice in the US, it behooves the Supreme Court to hear this important case to protect America’s farmers from abusive patent infringement lawsuits and invalidate Monsanto’s flawed patents as their products have been shown to be damaging to human health and the environment and failed to live up to the marketing hype,” Dave Murphy, a plaintiff in the case and founder of the advocacy group Food Democracy Now, said in a statement.
Monsanto issued a statement Thursday saying the plaintiffs were looking for controversy where it doesn’t exist.
"The District Court ruled and Court of Appeals affirmed that there was no controversy between the parties,"the company said in the statement. "There is neither a history of behavior nor a reasonable likelihood that Monsanto will pursue patent infringement against farmers who have no interest in using the company's patented seed products."

DANGER: Genetically Modified Crops Are Getting into Everything and Everyone
Why would we risk our health, threaten evolution and become dependent on chemical companies for our food?
Genetically Modified Organisms (GMOs) have been altered by humans who force non-food genes – from other species – into the DNA of plants, changing the very nature of the food itself.
Monsanto’s mutated seeds have taken over 90% of the U. S. soy crop and 95% of the corn. Wheat and fish are next on their agenda. Despite valiant and growing resistance around the world, GMO’s are still on the rise.
Why are GMO’s dangerous?
- GMO’s are bad for our health – In 2009, the American Academy of Environmental Medicine (AAEM) called for a moratorium on GM foods stating that “there is more than a casual association between GM foods and adverse health effects. There is causation.”[1] This was confirmed in several animal studies. Many doctors have also acknowledged that GM foods cause adverse health effects and are prescribing GM-free diets.[2] After reviewing more than 600 scientific journals, world renowned biologist Pushpa M. Bhargava, concludes that genetically modified organisms (GMOs) are a major contributor to the sharply deteriorating health of Americans.
- Animals exposed to GMO’s suffer lethal consequences – Lab rats, mice and chickens exposed to GMO’s, as well as sheep grazing on GMO crops, are often smaller. Most of their babies are dying and they are showing up with cancer, bleeding stomachs, black patches and major irritation in both their intestines and livers. GMO fed livestock have developed pro-lapsed uteruses, delivered offspring pre-maturely and become infertile. There is evidence that the DNA mutations from these GMO products transfers into our own stomachs and continues to function.[3]Monsanto’s Genetically modified corn is also causing organ failure in rats.[4]
- Some GMO seeds can’t reproduce – Monsanto (the largest biotech company in the world) has created a “terminator” seed that is unable to reproduce. This makes it impossible for farmers to save seeds and replant crops. They become dependent on biotech companies instead of nature in order to grow food. The newer, aptly named “traitor” seeds won’t even develop through the natural stages of the plant unless sprayed with Monsanto’s chemicals.
- GMO’s threaten evolution and freedom – The very course of evolution itself and the freedom of people to grow their own food are threatened. Millions of years of natural evolution and diversity of seeds are being wiped out in a generation - what we believe is a clear intention to control food worldwide.
- GMO takeover of farmers’ freedom is a major factor in suicides – Between 1997 and 2007, 182,900 farmers in India took their own lives. The National Crime Records Bureau of India estimates that there is roughly one suicide every 30 minutes. [5]
- GMO’s can contaminate other crops – GMO’s can cross-pollinate and spread their altered genes to other plants. These altered genes have the potential to spread far and wide, and make it into everyone’s food. Farmers whose crops have been contaminated have been repeatedly sued by Monsanto for violation of patent rights. [6]

- Pregnant women and babies are at great risk – Among others, biologist David Schubert of the Salk Institute warns that “children are the most likely to be adversely effected by toxins and other dietary problems” related to Genetically Modified foods. He says without adequate studies the children become “the experimental animals.” [7]
- GMO’s and the “Green Revolution” are not solving the global food crisis. They are making it worse. A four-year study by 400 scientists concluded in 2008 that monoculture and genetic modification of crops are creating significant problems and that small-scale organic farms are best qualified to feed the world. The study was virtually ignored by the US corporate press.[8]

OPPORTUNITY: Organic Farming is On the Rise and Becoming More Affordable
While GMO giants are desperately trying to dominate the agriculture industry, organic farming is rapidly gaining popularity. The number of certified organic farms in the U.S. has almost doubled in the last 10 years, which helps it to become affordable to more people.
Why is organic better?
- No pesticides and herbicides – organic foods are not sprayed with petroleum based toxins that poison farm workers, pollute our soils, water and air, and are bad for our health.
- Better farming practices – in order to keep healthy crops, organic farmers use more natural farming techniques such as crop rotation, composting and the interspersing of crops for natural predator resistance and soil health.
- It’s more nutritious and tastier – more nutrients from the soil give the food a better flavor.
There are still some problems with organic. For example, there are lots of industrial organic farms that only grow one crop, organic certification is expensive and the standards are being deceptively diluted.
Even more promising are the Permaculture and Biodynamic farming models. These go beyond organic standards and include more holistic approaches such as land conservation, biodiversity, and self-sufficiency.

- Buy Local and Organic as Much as Possible - Some grocery stores sell produce from local farmers, however, because it’s often cheaper and easier to go through big distributors our food is often shipped from hundreds or thousands of miles away, even when it’s being grown right down the road. To show your support for local farms, and to help get the cost down and the food accessible to more people, if you can afford it, buy local and organic as much as possible and voice your concern to managers at stores when options are limited.

WORLD SAYING “NO” TO GMO

Today I want to focus on just one issue as an example of the amazing self-generated work people are doing all over the world — and the issue I want to focus on for this episode of Good News Tuesday isGenetically Modified Organisms — GMOs.

We saw the March against Monsanto, on May 25 — millions marched and educated and the mainstream media did its best to ignore it. Hmmm…I wonder why that would be? (Here’s a hint…follow the money and the agenda for control. The same elite bankers who are trying to control food and energy and depopulate…also control the major media outlets.)
In May of this year, activists burned a thousand acres of covert GMO fields in Hungary, making clear that they mean it about banning genetic modification from their food supply.
In June in the state of Oregon — where Monsanto’s negligence with an abandoned GMO wheat field has infested neighboring fields and threatened wheat exports from the entire state — 6,000 GMO sugar beet plants in two separate Syngenta fields were uprooted by activists. It’s ironic that Syngenta is a Swiss company and GMO sugar beets are not even allowed in their own home country!
In the US, there are already 26 states challenging GMOs by insisting on labeling laws. Connecticut was the first state to pass such a law.
On July 24, 2013 the Monsanto Video Revolt was launched by Anthony Gucciardi of the Natural Society, Edward Group of the Global Healing Center, and Mike Adams of Natural News, with thousands of user videos being uploaded to YouTube and other video sites.
So let’s move on to India, where there have been hundreds of thousands of suicides by farmers struggling with failing crops and having to pay massive royalties for seeds that no longer reproduce. The Good News? In June,5 million farmers filed suit against Monsanto for $7.7 billion.
India is not only now refusing Monsanto’s patent applications, but is also charging Monsanto with “Conspiracy” for trying to “patent life” and for charging exorbitant fees that throw farmers into insurmountable debt.
Russia has recently banned the import or sale of Monsanto’s NK603 genetically engineered corn.
Italy, with the help of their ministries of agriculture, health and environment, and backed by 80% of the people, has also agreed to ban Monsanto GMO corn.
In China, shipments of Monsanto GMO corn were blocked and destroyed as “illegal under China’s GMO Bio-safety laws.”
As of a few days ago, Monsanto got so frustrated with its continuing failed attempts that the company has given up on getting their GM crops into Europe.
It’s a tremendous tribute to the awareness, organization and relentless courage of the European people, who now will need, unfortunately, to re-direct their initiative because a loophole in European law has allowed Monsanto to refocus its efforts on patenting natural crops like broccoli and green beans.

See the shocking photos
Here's the first photo of the teeth we used in this experiment. They were removed from the lower jaw of a wild boar found dead in the Texas outbreak. They were fully intact and had not been exposed to the elements. (Yes, I collect specimens from nature to bring back to the lab for investigations in the public interest.)To conduct the experiment, we then bathed these teeth in phosphoric acid.
This caused an immediate chemical reaction to take place, resulting in the off-gassing you see in this photo as the phosphoric acid ate away the tooth enamel:

Facts about the phosphoric acid teeth experiment
Here are some facts on how this was accomplished:• The Natural News Forensic Food Lab is located in Texas and conducts digital microscopy investigations on popular foods. See a previous investigation on "strange fibers" found in Chicken McNuggets.
• Both Coke and Pepsi contain phosphoric acid as a key ingredient, listed right on the label (see image, right).
• The teeth used in this experiment are mammalian teeth derived from a wild boar in Texas. These teeth were enclosed in the jaw bone and had never been exposed to the elements. (No animals were killed to conduct this research. Wild boars live and die every day in the Texas outback and are easily found already dead with fresh bones fully intact.)
• Wild boar teeth are almost identical to human teeth in terms of structure, physiology and elemental composition. Their properties of hardness and durability are, in fact, superior to most modern-day human teeth (because wild hogs have vastly superior nutrition than most modern-day humans who consume nutrient-depleted, processed foods loaded with toxic chemicals).
• Before being bathed in acid, the teeth were found to be relatively smooth, durable and hard. They were difficult to extract from the jaw bone and resisted scratching with common tweezers. We did not weigh the teeth before the acid bath but plan to do so in an expanded version of this experiment that looks at the total loss of tooth mass caused by phosphoric acid.
• The teeth were bathed in a solution of 85% phosphoric acid for a period of 12 hours. This concentration of phosphoric acid is much higher than the concentration typically found in soda products, so the effects you see here are accelerated compared to the effects you would see with the lower concentration acids typically found in soda.
• According to a 2012 Gallup poll, nearly half of all Americans drink soda daily, thereby bathing their teeth in phosphoric acid each day.
• According to these published soda facts, the average American drinks 45 gallons of sugary drinks each year. Each 20-ounce bottle of soda contains 16 teaspoons of sugar.
• Coca-Cola reportedly claims the actual amount of phosphoric acid in its sodas is "proprietary information" and thus not available to the public.
• A doctor quoted in ABC News confirms that the phosphoric acid in soda can destroy bones. "Phosphorus helps leech the calcium out of the bone, when it's absorbed very well in the sodas that people drink," said Dr. Loren Wissner Greene of New York University's Langone Medical Center.
• The pH of Coca-Cola is 2.525, just slightly higher than that of battery acid.
• According to a scientific study covered on LiveScience.com, "teeth immersed in Coke, Pepsi, RC Cola, Squirt, Surge, 7 Up and Diet 7 Up lost more than 5 percent of their weight, according to the report by Poonam Jain of the Southern Illinois University School of Dental Medicine and her colleagues." It goes on to report, "The erosive potential of colas is 10 times that of fruit juices in just the first three minutes of drinking, a study last year showed."
Phosphoric acid damages your teeth as much as using meth
This story gets even more shocking when you realize that phosphoric acid from soda may damage your teeth as much as using meth or other illegal drugs."Drinking large quantities of your favorite carbonated soda could be as damaging to your teeth as methamphetamine and crack cocaine use," says a press release from the Academy of General Dentistry.
To conduct the study, "the General Dentistry case study compared the damage in three individuals' mouths -- an admitted user of methamphetamine, a previous longtime user of cocaine, and an excessive diet soda drinker. Researchers found the same type and severity of damage from tooth erosion in each participant's mouth," reports the AGD press release.
"Each person experienced severe tooth erosion caused by the high acid levels present in their 'drug' of choice -- meth, crack, or soda," said Mohamed A. Bassiouny, DMD, MSc, PhD, lead author of the study.

More states attempting to thwart freedom of health speech by requiring individuals to be professionally licensed before sharing information

(NaturalNews) Freedom of speech, which includes the right to freely share information with others without interference or threat from the state, is one of the most fundamental tenets of American civil society. But this foundational and constitutionally-protected principle is under attack in a growing number of states where state licensing boards are increasingly trying to restrict freedom of health speech and limit it only to those who first receive permission from the government to give it.
One of the first major incidents of this in recent years involves the North Carolina Board of Dietetics / Nutrition (NCBDN), which, in 2012, decided to go after health blogger Steve Cooksey for posting information online about how he cured himself of diabetes through diet. The medical establishment in North Carolina, which is among the most restrictive and domineering in the nation, actually threatened to file a lawsuit against Cooksey in an attempt to shut him up.
Cooksey later filed a complaint in district court against NCBDN for violating his First Amendment rights, which was ultimately dismissed on the grounds that Cooksey allegedly did not suffer an actual or imminent injury-in-fact. But Cooksey appealed this ruling, and the United States Court of Appeals for the Fourth Circuit recently decided that his case does, indeed, have merit and can move forward, which is a major win for health freedom.
But, unfortunately, Cooksey is not the only one being harassed by state licensing boards for speaking his mind. Licensed family physician John Rosemond recently received a cease-and-desist letter from the Kentucky Attorney General's office for an article he wrote that was published in a local Lexington-based newspaper. Since Rosemond is licensed to practice in North Carolina rather than Kentucky, the state's Board of Examiners of Psychology (BEP) is of the opinion that his newspaper advice column somehow violates the law.
And all the way across the country in Washington state, the so-called Medical Quality Assurance Commission (MQAC) has launched its own attack on free speech by targeting integrative physician Dr. Jonathan Wright, M.D. According to recent reports, this board went after Dr. Wright, who just so happens to embrace nutrition-based healing and other unconventional treatment protocols, by falsely claiming that he was "aiding and abetting the unlicensed practice of medicine." Dr. Wright ultimately lost his license based on these false charges, and is now being ordered to write a paper on the importance of proper licensure.
